Terms and Conditions
Effective Date: August 9, 2026
These Terms and Conditions (“Terms”) govern your use of www.ergaragedoor.com and any garage door repair, maintenance, inspection, opener installation, or related service provided by SZK Solutions LLC, doing business as ER Garage Door (“ER Garage Door,” “we,” “us,” or “our”).
By requesting an estimate, scheduling an appointment, approving work, paying a deposit, receiving services, or using our website, you agree to these Terms.
1. Our Services
ER Garage Door is a mobile garage door repair business serving Austin, Texas, and surrounding communities.
Our services may include garage door spring repair and replacement; cable, roller, hinge, track, and hardware repair; off-track garage door repair; garage door opener repair and installation; sensor, remote, and keypad services; weather-seal installation; safety inspections; maintenance; lubrication; adjustments; and tune-ups.
ER Garage Door provides repair, maintenance, and related services. We do not provide complete garage door replacement.
The specific work being performed will be described in the applicable estimate, work order, invoice, or other service documentation approved by the customer.
2. Estimates and Diagnosis
Any estimate provided before an on-site inspection may be preliminary and may be based on information, photographs, videos, or descriptions provided by the customer.
The final price or scope of work may change after we inspect the garage door system and determine the actual condition of the door, springs, tracks, opener, cables, hardware, framing, electrical connections, or other components.
Unless expressly stated otherwise in writing, an estimate does not guarantee that additional problems will not be discovered, does not include work or parts outside the stated scope, and may be revised when concealed damage, unsafe conditions, incompatible parts, incorrect customer information, or additional necessary repairs are discovered.
We will inform the customer of material changes to the scope of work or price before performing additional chargeable work.
3. Customer Approval
ER Garage Door will not begin chargeable repair work until the customer or an authorized representative approves the work and the price.
Approval may be documented through a written or electronic signature, acceptance of an electronic estimate or invoice, email, text message, recorded communication, or another reasonably documented form of authorization.
If additional work becomes necessary after repairs begin, we will request approval before performing the additional chargeable work, except when immediate action is reasonably necessary to prevent injury or further property damage.
The person approving the work represents that they own the property or are authorized by the property owner to approve the work and related charges.
4. Deposits
A deposit may be required before an appointment is confirmed, parts are ordered, or work begins.
The amount of any required deposit will be disclosed on the estimate, invoice, or payment request and will be applied toward the total amount due for the approved services.
If a customer cancels after special-order or nonreturnable parts have been ordered, supplier or restocking charges have been incurred, work has already been performed, or other documented nonrecoverable expenses have been incurred, ER Garage Door may apply the deposit toward those costs.
Any remaining refundable balance will be returned as required by applicable law.
Nothing in this section limits any cancellation or refund right that cannot legally be waived.
5. Scheduling and Arrival Times
Appointment times and arrival windows are estimates.
Garage door service may be affected by traffic, weather, supplier delays, unexpected repair conditions, emergency service calls, or earlier appointments requiring additional work.
We will make reasonable efforts to arrive within the scheduled window and notify the customer of significant delays when practical.
Unless expressly agreed to in writing, ER Garage Door does not guarantee an exact arrival time or completion time.
Same-day service may be available but is not guaranteed.
6. Customer Responsibilities
The customer is responsible for providing accurate contact and service-address information and safe, reasonable access to the garage and garage door.
Before service begins, vehicles, personal belongings, fragile items, valuables, children, and pets should be moved or secured away from the work area.
The customer must disclose any known structural, mechanical, electrical, water, pest, or other safety problems that may affect the work.
The customer is responsible for obtaining any required authorization from a property owner, landlord, property manager, homeowners association, or other party.
ER Garage Door is not responsible for delays, additional labor, or inability to perform work resulting from blocked access, unsafe conditions, undisclosed problems, or failure to reasonably prepare the work area.
7. Safety and Right to Refuse or Stop Work
Garage doors, torsion springs, extension springs, cables, openers, and related components can store substantial force and may cause serious injury or property damage if damaged or handled improperly.
Customers, children, pets, and other persons must remain outside the technician's immediate work area unless instructed otherwise.
ER Garage Door may refuse, pause, or stop work when we reasonably determine that the work area is unsafe; the door or structure is unstable; electrical or structural work requires another qualified professional; people or animals are interfering with the work; the requested repair would be unsafe or improper; necessary safety-related work is refused; or threatening, abusive, discriminatory, or dangerous conduct occurs.
The customer remains responsible for authorized work performed and parts supplied before service is stopped, except where applicable law requires otherwise.
8. Existing and Hidden Conditions
Garage door systems may contain components that are old, worn, damaged, altered, improperly installed, previously repaired, or incompatible with other components.
ER Garage Door is not responsible for preexisting conditions outside our approved scope of work, including previous improper repairs or installation, structural movement, damaged framing, weakened or rotten wood, defective electrical wiring, water damage, pest damage, fire or storm damage, impact damage, manufacturer defects, ordinary wear and tear, or concealed conditions that were not reasonably visible before work began.
Repairing one component may reveal another existing problem. Restoring proper operation to one component may also place normal operating forces on other worn components.
The later failure of a different component does not, by itself, establish that the original repair was defective.
Additional work discovered during service will require customer approval before additional charges are incurred.
9. Parts and Product Availability
Part brands, models, designs, colors, finishes, and availability may change because of manufacturer or supplier availability.
If an exact replacement is unavailable, ER Garage Door may recommend a reasonably comparable compatible part.
Customer approval will be obtained if a proposed substitution materially changes the price, functionality, or approved scope of service.
Replacement parts may look different from the original components while still being compatible with the garage door system.
10. Customer-Supplied Parts
ER Garage Door may decline to install a customer-supplied part if we reasonably believe it is unsafe, damaged, used, incomplete, incompatible, incorrectly sized, or otherwise unsuitable.
When we agree to install a customer-supplied product or part, the customer is responsible for selecting and purchasing the correct product.
ER Garage Door does not guarantee the quality, condition, compatibility, durability, or performance of customer-supplied parts.
Additional labor charges may apply if the supplied product is incorrect, incomplete, defective, or requires additional removal or installation work.
Any manufacturer or seller warranty on a customer-supplied product is the customer's responsibility.
11. Additional Work and Change Orders
An approved estimate covers only the services and parts specifically described in that estimate.
Additional services or parts require additional customer approval and may result in additional charges.
Examples may include additional damaged components discovered during the repair, customer-requested changes, additional labor required because of previous improper work, additional trips caused by unavailable or incorrect customer-supplied parts, or work required to correct unsafe or incompatible conditions.
Approval may be documented through an updated estimate, invoice, signature, email, text message, or other recorded authorization.
12. Payment
Unless otherwise stated in writing, the remaining balance is due upon completion of the approved work.
ER Garage Door may accept available payment methods including credit card, debit card, electronic invoice, bank or electronic payment, and cash.
The customer agrees to pay all approved charges, including authorized labor, parts, deposits, and additional approved work.
Customers should raise billing questions promptly after receiving an invoice.
Initiating a payment dispute or chargeback does not eliminate responsibility for valid charges relating to authorized services or parts.
ER Garage Door may pursue unpaid balances and reasonable collection expenses to the extent permitted by applicable law.
13. Cancellations and Rescheduling
Customers should contact ER Garage Door as soon as reasonably possible if they need to cancel or reschedule an appointment.
If no work has begun and no parts or nonrecoverable expenses have been incurred, an eligible deposit may be refunded.
If the customer cancels after special-order parts have been ordered, documented nonrecoverable expenses have been incurred, or authorized work has begun, the customer may remain responsible for those costs.
Special-order or nonreturnable parts may not be refundable except where required by law.
Nothing in these Terms limits a cancellation or refund right provided by applicable federal or Texas law.
14. Certain In-Home Transactions
Certain consumer transactions entered into at a customer's residence or another location away from a merchant's regular place of business may be subject to cancellation rights under federal or Texas law.
Whether a particular cancellation right applies depends on the circumstances of the transaction, including how the service was requested and what goods or services were purchased.
When required by applicable law, ER Garage Door will provide any required cancellation notice, form, or instructions.
Nothing in these Terms waives or limits a cancellation right that cannot legally be waived.
Texas Chapter 601 contains notice and cancellation-form requirements for qualifying personal-solicitation transactions, while the FTC rule contains specific definitions and exceptions, including certain customer-requested home repair visits.
15. Completion and Customer Inspection
Customers should inspect completed work when reasonably possible and promptly notify the technician of any visible concern.
If a concern arises after service, the customer should contact ER Garage Door promptly so that we have a reasonable opportunity to inspect the issue and determine whether it relates to our work, another garage door component, ordinary wear, misuse, outside damage, or another condition.
Payment or acknowledgment of completion does not waive any consumer right that cannot legally be waived.
16. No Separate Stated Warranty
Unless a specific estimate, invoice, product document, or separate written agreement expressly states otherwise, ER Garage Door does not provide a separate written labor or workmanship warranty for a specified period.
Any applicable manufacturer's warranty covering a product or component is provided by the manufacturer and is subject to the manufacturer's own terms, exclusions, registration requirements, and claims procedures.
ER Garage Door may assist customers in identifying applicable manufacturer information but does not control whether a manufacturer approves or denies a warranty claim.
Nothing in these Terms excludes or limits a warranty, remedy, or consumer right that cannot legally be excluded or limited.
17. Conditions Not Caused by Our Work
ER Garage Door is not responsible for problems caused by misuse, abuse, impact, accident, vandalism, storms, flooding, fire, lightning, electrical surges, work or modifications performed by another person, failure to follow operating or maintenance instructions, ordinary wear and tear, building movement, structural defects, electrical-supply problems, internet or Wi-Fi problems, third-party smart-home systems, customer-supplied parts, or conditions outside the approved scope of work.
18. Limitation of Liability
To the fullest extent permitted by law, ER Garage Door will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from a service, including loss of use, lost income, lost business, or damages resulting solely from delays.
For a claim directly arising from a specific service, ER Garage Door's total liability will not exceed the amount actually paid to ER Garage Door for the specific service giving rise to the claim, except where a different limitation is required by applicable law.
Nothing in these Terms is intended to exclude or limit liability for fraud, gross negligence, willful misconduct, personal injury where liability cannot legally be limited, or any other liability that applicable law does not allow us to exclude or limit.
19. Removed Parts and Disposal
Unless the customer asks to retain an old part before work begins, removed parts and materials may be discarded, recycled, returned to a supplier, or otherwise disposed of by ER Garage Door.
Certain parts may need to be returned to a manufacturer, distributor, or supplier in connection with a warranty, core return, or similar requirement.
Customers who want to retain removed components should notify the technician before work begins.
20. Photographs, Video, and Service Records
ER Garage Door may photograph or record the garage door system, damaged components, serial numbers, work area, and completed repairs when reasonably necessary for diagnosis, estimate preparation, service documentation, safety records, payment records, warranty documentation, training, or dispute prevention.
We will not intentionally use identifiable photographs or video showing a customer's face, home address, vehicle license plate, or other personally identifying private information for advertising or promotional purposes without appropriate permission.
Non-identifying photographs of garage door components or completed work may be used for advertising, educational or business purposes when they do not reasonably identify the customer or property.
21. Website Information
ER Garage Door makes reasonable efforts to maintain accurate website information, but information may occasionally contain errors or become outdated.
Website descriptions, photographs, educational content, general price examples, service descriptions, and estimated completion times are provided for general informational purposes and do not constitute a binding service quote.
The customer's approved estimate or work order controls the specific scope and price for that service.
22. Website Use and Intellectual Property
You may use our website only for lawful purposes.
You may not intentionally interfere with the website's operation or security, submit fraudulent service requests, impersonate another person, falsely represent your authority, use automated systems to damage or overload the website, or copy and commercially use ER Garage Door branding, logos, photographs, or original website content without permission.
Content owned by ER Garage Door remains our property and is protected to the extent provided by applicable intellectual-property law.
23. Third-Party Services
Our website, estimates, invoices, or communications may contain links to or integrations with third-party services such as payment processors, scheduling platforms, map providers, manufacturers, social-media platforms, or other service providers.
ER Garage Door does not control third-party services and is not responsible for their independent availability, content, security, privacy practices, or terms.
24. Electronic Communications and Signatures
By contacting ER Garage Door electronically, requesting service, approving an estimate, or paying an invoice electronically, you consent to receive service-related communications through reasonable methods such as telephone, email, text message, electronic documents, or electronic invoices.
Electronic signatures, approvals, records, and communications may be used to document agreements and authorizations to the extent permitted by law.
Consent to receive service-related communications does not automatically constitute consent to receive promotional text messages or other marketing communications when separate consent is legally required.
25. Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.
26. Dispute Resolution
If a problem arises regarding our services, the customer and ER Garage Door agree to make a reasonable good-faith effort to resolve the matter directly before filing a legal claim, when practical.
Customers may contact:
service@ergaragedoor.com
Please provide the customer's name, service address, date of service, estimate or invoice number if available, a description of the concern, and any relevant photographs or documents.
Nothing in this section prevents either party from seeking urgent legal relief or exercising a legal right that cannot be restricted.
27. Governing Law and Venue
These Terms and services provided by ER Garage Door are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent legally permitted, any legal proceeding relating to these Terms or services provided by ER Garage Door shall be brought in a court of competent jurisdiction in Travis County, Texas.
28. Conflicts Between Documents
A customer's estimate, work order, invoice, or other approved service document may contain terms specifically applicable to that service.
If a conflict exists between these website Terms and a signed or electronically approved service document, the service-specific document will control for that particular service unless applicable law requires otherwise.
29. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in effect.
30. No Waiver
If ER Garage Door does not immediately enforce a provision of these Terms, that does not waive our ability to enforce that provision later.
31. Changes to These Terms
We may update these Terms from time to time.
Any updated version will be posted on our website with a revised effective date.
Changes will apply prospectively and will not alter an already approved service agreement unless the customer agrees or applicable law permits the change.
